HELP!!! Taken off schedule at work, but never fired!!?

I started working at a restaurant in NYC about 6 months ago. I started out as a hostess and did well. The manager actually told me I was the best hostess he鈥檚 ever seen. Fast-forward to 5 weeks ago after some little issues with a couple servers the last months, my manager told me that because it was so slow he didn鈥檛 need a host for about two weeks. I come in a week later to pick up my check and another girl is hosting there. I ask him about it and he tell me she鈥檚 only training for the other restaurant (that hasn鈥檛 opened yet). He then tells me that the owners fired some people but he鈥檒l call me the first week of September, whether it was good or bad. It鈥檚 now the 17th and I haven鈥檛 heard from him. Can I do anything about this??

It looks like they are trying to fire you in a way that gives them deniability if you file for unemployment benefits.
Why haven't you been looking for another job all along? You've been working under the table, which is illegal, and you're in a very dicey business where people get laid off all the time, and the economy stinks and restaurant biz is declining. He's probably not going to fire you, and you'd better believe you have no way to apply for or collect unemployment. So get out there and start looking for another job. Employers can choose to keep you employed or not. As long as they aren't discriminating for a protected class reason (i.e. sex, race, etc). It sounds like you were doing well. I'd stop back in and have a conversation with the manger. If you like the place and want to keep working there then take the initiative to keep in touch. If they still don't have the ability to employ you right now, try to pin them down to a date when they will. Otherwise, move on.

The "little issues with couple servers" perhaps were not little to your boss.

That sounds like they are ready to terminate you. When ever we are ready to terminate some one at work the first thing we do is cut down their hours drastically. However, they should have had some contact with you regarding their reasons for cutting your hours/firing you. Especially if they never formally fired you. I would go above them and contact a corp. office if there is one. It sound like they are not being too professional about it.
No there is nothing you can do. You were fired without all the drama because you have no contract, only a schedule. Without the schedule, you do not work. Find out if you can get unemployment but I seriously doubt it because you were paid under the table and they didn't pay into the system for you. If you are good at hostessing, instead of sitting on your "host" go out and look for another job. There are more restaurants in NYC than there are derelicts in the indie music scene and there seems to be at least 50000 of them!
